二 |           　　近日，山东省高级人民法院召开贯彻实施生态环境法典暨司法服务保障美丽中国省域先行区建设新闻发布会，对外发布一批司法保障美丽山东建设典型案例，其中一起非法采矿案件引发广泛关注，该案中，违规企业超标采矿后，对土地进行生态修复，获得从宽处理，体现司法惩治与生态修复并重的裁判导向。     　　涉案的某新型材料公司运营济南长清区东马山矿区石灰岩开采项目，邢某某、王某某为该公司主管人员。在采矿许可证明确的最低开采标高到达后，2018年1月至2021年5月，二人向第三方提供虚假开采标高数据，5个矿段违规超标高开采石灰岩232万余立方米，折合约581.6万吨，涉案价值9300万余元。     　　济南市自然资源局此前已对涉事企业作出没收违法所得1.2亿余元并处罚款的行政处罚。

三 | 检察机关提起公诉前，该企业完成1000余亩土地复垦并通过行政验收。法院实地勘查确认，案涉区域已经复垦为耕地，现已种植玉米，企业持续对复垦地块开展管护。

四 |      　　济南市长清区人民法院审理认为，被告单位超出许可范围采矿，情节特别严重，两名主管人员行为已构成非法采矿罪。结合企业全额退缴违法所得、完成矿山生态修复，被告人认罪认罚、具有立功情节等因素，依法作出判决：判处某新型材料公司罚金一千二百万元;邢某某、王某某有期徒刑四年，并各处罚金七十万元。     　　该案是刑事追责、行政处罚、生态修复责任有效衔接的司法样本。

五 | 非法采矿会破坏山体与土地结构，威胁区域生态安全。本案裁判将矿山复垦修复实际成效纳入量刑考量，在严厉打击生态环境犯罪的同时，落实“谁破坏、谁修复”原则，为矿产资源开发和山体生态系统治理提供司法参考。
